PROMOTION AND PRIZE DESCRIPTION: Pursuant to the RushmoreDrive.com 2009 Range Rover Sport Sweepstakes (the "Promotion"), registered members of the Rushmoredrive.com website ("RushmoreDrive.com Members") as of 11:59 P.M. Eastern Standard Time ("ET") on Sunday, July 6, 2008, who remain RushmoreDrive.com Members through 11:59 P.M. ET on Friday, September 5, 2008, will be eligible to win the following prize (the "Prize")
One (1) Grand Prize Winner will be randomly selected in the 2009 Range Rover Sport Sweepstakes to receive a 24-month, 15,000 annual mile lease of a 2009 Range Rover Sport. The Approximate Retail Value ("ARV") of the 24 lease payments is $24,000. The winner will be required to meet and agree to all the terms and conditions of Land Rover Capital Group, PO Box 542000, Omaha, NE, 68154-8000 (including mileage limitations). The amount of the twenty-four (24) monthly lease payments and any applicable down payment will be paid by the Sponsor; however the lease will be executed in the name of the winner and the winner assumes all responsibilities associated with the lease. The amount of the monthly lease payments and any applicable down payment does not include title, tag, registration fees or applicable taxes, which are the sole responsibility of the winner. The color of the vehicle is subject to availability of dealer. Actual lease vehicle may vary from promotional images of the vehicle. There are no additional warranties on the vehicle except as may be offered by the manufacturer. Winner must be a licensed and insured driver and will be responsible for picking up the vehicle at an authorized Land Rover dealership nearest the winner’s home as specified by the Sponsor. Allow 4 – 6 weeks days for delivery of vehicle after verification of prize claim and eligibility. The winner must pick up the vehicle within 14 days of notice that the vehicle is available. The winner shall be responsible for all other costs and expenses associated with the lease of the vehicle, including but not limited to insurance, fuel, tolls, routine maintenance, excess mileage, excess wear & tear or damage to the car and all applicable taxes.START AND END DATE OF PROMOTION: The entry period for the Promotion begins at 12:01 A.M. ET on Monday, July 7, 2008 and ends at 11:59 P.M. ET on Friday, September 5, 2008 (the "Entry Period").
ELIGIBILITY: No purchase is necessary to enter or win the Promotion. The Promotion is only open to legal residents of the United States who are (18) years of age or older at the time of entry and who, as of 11:59 P.M. ET on Sunday, July 6, 2008, are RushmoreDrive.com Members and who remain RushmoreDrive.com Members through 11:59 P.M. ET on Friday, September 5, 2008. The Promotion is void in states and/or jurisdictions where prohibited or otherwise restricted by law. The Promotion is not open to employees of Sponsor or Land Rover or their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies or any of their respective officers, directors and employees, or any persons or entities directly associated with this promotion (collectively, the "Promotion Entities") or members of the immediate families and/or persons living in the same household as such persons, and accordingly none of these persons is eligible to win the Prize.
ENTRY: Eligible RushmoreDrive.com Members may enter the Promotion on the RushmoreDrive website located at www.rushmoredrive.com by following the instructions therein to enter the Promotion. One (1) entry per RushmoreDrive.com Member every 24 hours. To become a RushmoreDrive.com Member, click HERE. Registration is free. You must become a RushmoreDrive.com Member by 11:59 P.M. ET on Sunday, July 6, 2008 and remain a RushoreDrive.com Member through 11:59 P.M. on Friday, September 5, 2008 in order to be eligible for the random drawing. Entry in the Promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
DRAWING & WINNER SELECTION: One (1) winner will be selected in a random drawing conducted by Sponsor from the database of all eligible entrants in the Promotion. This selection will be made within three (3) business days following the end of the Entry Period. Decisions of Sponsor are final and binding in all respects. The winner will be notified by e-mail and or telephone within five (5) business days following the end of the Entry Period. Odds of winning depend upon the total number of eligible entries received.
PRIVACY: Except as otherwise stated in these Official Rules, personal information collected in connection with the Promotion will be used in accordance with the Sponsor's PRIVACY POLICY.
GENERAL PRIZE AND PROMOTION CONDITIONS: The winner of the Prize shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Prize. The Prize shall be nonassignable and nontransferable. No cash alternative or substitutions for the Prize will be allowed, except that Sponsor reserves the right to substitute prize(s), or any portions thereof, of comparable value if the Prize, or any portion thereof, is unavailable for any reason. The winner of the Prize may be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release or other documentation relating to the Prize (collectively, "Prize Claim Documents") in order to receive the prize. If a selected winner fails or refuses to sign and return any and all Prize Claim Documents within five (5) business days of attempted notification, the winner may be disqualified and another winner will be selected in accordance with the procedures set forth under the caption "Drawing & Winner Selection" above.
INDEMNIFICATION: Each entrant in the Promotion hereby agrees to indemnify and hold the Promotion Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of the Official Rules, or TERMS & CONDITIONS of use of Sponsor's website.
GENERAL LIABILITY RELEASE/FORCE MAJEURE: The Promotion Entities (A) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from the Promotion or any related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any portion of the Prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any portion of the Prize, including, without limitation, to any portion of the Prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s computer system which is occasioned by accessing the website or participating in the Promotion, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, late, lost, damaged or stolen Prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion or the website, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding any portion of the Prize or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Promotion. If the Promotion is terminated before the designated end date, Sponsor will (if possible) select the winner from all eligible entrants as of the date of the event giving rise to the termination.
DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in North Carolina. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than North Carolina
